What Does Success Look Like To You?

After the fall: Common biking injuries—Who is responsible for them?

The end of the summer is a great time to cycle around. But what if you get injured on the road? Who is responsible for the damages?  How can you get the compensation you need? Here are some useful things you should know.

Potential hazards on a bike

According to the American Academy of Family Physicians, cycling injuries are more common on arms and legs, but can also include the rest of the body. These are some of the most common ones:

  • Scrapes: from superficial “road rash” to deeper skin loss caused by friction.
  • Trauma: bruises or internal injuries from a hard impact or collision.
  • Strains and fractures: torn ligaments, sprains and broken bones.

Protective gear, such as a helmet and gloves, can lessen the gravity of some of these potential injuries. Remember to follow applicable bike laws and regulations. For example, the state of Illinois forbids carrying a package or bundle that might impede the use of both hands to steer a bicycle.

What to do if you are injured

First and most important, you have to seek medical assistance immediately. Second, and while help is on the way, you can document the conditions of the road or trail where you were injured, your injuries and the testimony of any potential witnesses. This will be useful if you decide to file a police report and pursue legal action.

Who is responsible if you are injured in an accident?

That depends on the circumstances. For instance, if you fell due to a poorly maintained trail on a public space, the municipality could be accountable for your accident. In contrast, if you were injured on a private trail that was neglected or dangerous to ride in, the property owner would likely be held responsible.

From minor mishaps to serious accidents, you have the right to know what to do if you encounter a similar situation while cycling. You can talk to a lawyer so that you can make an informed decision on the road ahead.
